In addition, the infant’s mother claimed that the hospital offered no apology or explanation as to what went wrong.

As a result of the brain injury, the boy – now 12 years old – is unable to speak or walk. Because of his physical and mental impairments, the costs associated with his brain injury – including medical expenses, diminished quality of life, and shortened lifespan – are immense. While the hospital claimed that the injury was a result of an infection the mother acquired during her pregnancy, the jury ruled that the hospital was responsible, and that the limited care provided by nurses and doctors was what caused the injury. The jury awarded the family $53 million to cover past and future medical expenses, and other related costs.
