Baltimore Birth Injury Lawyers: Multi-Million Dollar Settlement

Baltimore Birth Injury Lawyers at LeViness, Tolzman & Hamilton Advocate for Victims of Medical NegligenceWhen something goes wrong in an otherwise routine pregnancy, it is imperative that the mother and unborn baby receive immediate medical attention. If this treatment is delayed for any reason, it can have devastating consequences, including severe, permanent brain damage. Unfortunately, this is what happened to a Chicago family 12 years ago when their son was born with a severe brain injury. Allegedly, hospital staff failed to provide immediate care to the mother who was in need of an emergency C-section, and the unborn child who had been showing symptoms of fetal distress. The family has been awarded an unprecedented $53 million for the negligent care they allegedly received.

Upon entering the hospital, the child’s mother assumed she would have a routine delivery, as her pregnancy had been healthy. She also assumed that she and her unborn baby were in good hands and would receive the best medical care available. Unfortunately, once she went into labor, things took a turn for the worse after doctors or nurses did not check on her for an extended period of time. During this time, her baby went into fetal distress.

When a baby shows signs of fetal distress, it is imperative that the medical staff act quickly and provide the necessary treatment to protect the health and safety of the mother and her unborn child. When this does not happen, and the baby’s brain does not get the oxygen and other key nutrients it needs, it can result in severe, permanent brain damage. According to the lawsuit, the medical staff allowed the child to remain in distress for more than 12 hours. In addition, the infant’s mother claimed that the hospital offered no apology or explanation as to what went wrong.

High Cost of Permanent Brain Injuries

As a result of the brain injury, the boy – now 12 years old – is unable to speak or walk. Because of his physical and mental impairments, the costs associated with his brain injury – including medical expenses, diminished quality of life, and shortened lifespan – are immense. While the hospital claimed that the injury was a result of an infection the mother acquired during her pregnancy, the jury ruled that the hospital was responsible, and that the limited care provided by nurses and doctors was what caused the injury. The jury awarded the family $53 million to cover past and future medical expenses, and other related costs.
